Terms of Use
These terms govern your use of hedgemountain.com (the “Site”), operated by Growth Preservation LLC (“HedgeMountain,” “we” or “us”). By using the Site you agree to them. If you do not agree, please do not use the Site.
1. Information only
The Site provides information drawn from public filings with the U.S. Securities and Exchange Commission, estimates derived from those filings, and content supplied by fund managers. Nothing on the Site, in our emails or in any communication from us is an offer to sell, a solicitation of an offer to buy, or a recommendation of any security, fund or strategy, or investment, legal, tax or accounting advice. HedgeMountain is not a broker-dealer, investment adviser or funding portal. Any offer of a fund is made only by that fund, through its own offering documents, to investors eligible to receive them.
2. No warranty on data
Filing data is republished as filed and is not verified by HedgeMountain. It may be incomplete, out of date or wrong. Performance estimates based on Form 13F are approximations of a firm's disclosed U.S. stock holdings, not the return of any fund. Manager-reported returns are not audited by us. Past performance does not guarantee future results. Do your own research and consult qualified professionals before making any investment decision.
3. Sponsored content and conflicts
Some placements on the Site are paid for or promote a fund managed by an affiliate of HedgeMountain's operator. They are labeled “Sponsored.” Sponsorship is not an endorsement and does not affect search results, rankings or the data shown for any fund. See the Disclosures for details.
4. Manager accounts and content
If you claim a listing or submit content, you confirm that you are authorized to act for the fund or firm, that the content is accurate and not misleading, and that publishing it complies with the securities laws that apply to the fund, including any limits on general solicitation. You grant HedgeMountain a non-exclusive, royalty-free license to display, format and distribute that content on the Site and in related communications. We may edit, decline or remove any content, and we do not publish performance figures for funds offered under Rule 506(b). Paid services are described at the time of purchase and may be canceled as stated there.
5. Email sign-ups
Signing up for updates is optional. We use your information as described in the privacy section of our Disclosures. You can unsubscribe from any email at any time.
6. Acceptable use
You may use the Site for personal or business research. You may not copy the Site or its compilations in bulk, use automated tools that place an unreasonable load on it, attempt to access non-public areas, interfere with its operation, or use it to send spam or for any unlawful purpose. The underlying SEC filings are public and remain available from the SEC.
7. Intellectual property
The Site's design, text, compilations, estimates and software belong to HedgeMountain or its licensors. Fund, firm and database names are the property of their owners and are used for identification only.
8. Limitation of liability
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, merchantability and fitness for a particular purpose. To the fullest extent allowed by law, HedgeMountain and its operator, members and affiliates are not liable for any direct, indirect, incidental, consequential or other damages, including investment losses, arising from your use of or reliance on the Site. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim, or $100 if you paid nothing.
9. Indemnity
If you submit content or use the Site in breach of these terms, you agree to indemnify HedgeMountain against claims, losses and costs arising from that content or breach.
10. Third-party links
Links to SEC.gov, fund websites and other sites are provided for convenience. We are not responsible for their content or practices.
11. Changes and governing law
We may change the Site or these terms at any time; the updated terms apply from the date posted. These terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules, and any dispute will be resolved in the state or federal courts located in Colorado.
